THE EFFECTIVENESS OF THE FUNDAMENTAL RIGHTS OF CHILDREN AND ADOLESCENTS IN THE FACE OF CHILD LABOR IN THE STATE OF MARANHÃO: ADVANCES AND SETBACKS IN LIGHT OF THE 1988 CONSTITUTION

This article analyzes the effectiveness of the constitutional protection of children's and adolescents' fundamental rights in combating child labor in the State of Maranhão, Brazil, in light of the 1988 Federal Constitution. It is based on the hypothesis that the persistence of child labor constitutes a case of unconstitutional omission by the State, due to insufficient public policies. The research adopts a qualitative approach, based on bibliographic review and documentary analysis of statistical data and reports from national and international organizations. The results indicate that, despite the existence of a robust legal framework, the realization of fundamental rights remains limited by structural, institutional, and socioeconomic factors. It is concluded that overcoming child labor requires the effective implementation of integrated public policies and greater state commitment to ensuring fundamental rights.
