THE INVISIBLE POLITICAL SUBJECT: CRITICAL HERMENEUTICS AND THEORIES OF JUSTICE IN THE PROTECTION OF PERSONAL RIGHTS AND THE DIGNITY OF WOMEN

This article proposes an analysis of human dignity as the foundation of a substantive theory of justice, articulated with critical hermeneutics and the recognition of political rights as highly personal rights (personality rights) of women. It starts from the social observation of female invisibility and exclusion from spaces of power. Understanding that such invisibility does not constitute an isolated anomaly, but rather the result of historical structures of invisibilization, the study examines the contributions of Heidegger, Foucault, Bourdieu, and Iris Marion Young to demonstrate that this invisibility of the female subject within political institutions is a democratic deficit produced and naturalized by the legal system itself. The underrepresentation of women in Brazilian politics is then analyzed in light of the ideas of Dworkin, Alexy, Fraser, and Rawls as a systemic failure in the optimization of factual equality and as a violation of the right to equal treatment, revealing that the equality formally proclaimed by the 1988 Constitution remains insufficient as long as the factual structures of exclusion are not addressed by adequate normative instruments. The research employs a deductive method with a qualitative approach, based on bibliographic research, as it is founded on established concepts and an in-depth analysis of specialized scientific works and articles related to legal hermeneutics, theories of justice, and studies on dignity, personality rights of recognition, and women's political participation. Critical hermeneutics, from the perspective of Lenio Streck, is presented as an indispensable method to unveil this democratic unthought and promote the reconfiguration of Law as an instrument of substantive justice, committed to the dignity of women as full political subjects.
