EMPIRICAL-NORMATIVE MATURITY SCALE (EMEN): A MODEL FOR EVALUATING THE DEVELOPMENT OF LEGAL NORMS BASED ON THE TRL/MRL SCALE

This article aims to develop and validate the Empirical-Normative Maturity Scale (EMEN) , inspired by the Technology Readiness Level (TRL) and Manufacturing Readiness Level (MRL) methodologies. The formulation of legal norms is a complex process, and the absence of a systematic criterion to evaluate the maturity of these norms compromises their effectiveness and applicability. Frequently, laws are drafted without robust empirical and normative grounding, leading to regulatory gaps and implementation difficulties. In this context, EMEN seeks to establish gradual parameters to assess the progress of legal norms, from their conception to their implementation and revision , thereby contributing to more informed legislative decision-making. The hypothetical-deductive method and a non-systematic bibliographic review research methodology were utilized in the study. The EMEN's construction was based on a systematic literature review and documental analysis. The scale is structured into nine progressive levels, starting from the absence of regulation (Level 1) to the scientific analysis of its effectiveness after implementation (Level 9). Thus, EMEN seeks to aid in the construction of more effective legislations aligned with contemporary social and technological needs, serving as an innovative methodological tool for the evaluation of legal norms in the fields of Law and Innovation Management.
