POBREZA E INSTITUCIONALIZAÇÃO DE CRIANÇAS E ADOLESCENTES: UMA RELAÇÃO ECONÔMICA OU MORAL?

This essay intends to present a reflection on the relation between poverty and institutionalization of children and adolescents in Brazil. It is pointed out that, although the current legislation does not recognize family economic under-sufficiency as a reason institutionalize children and adolescents, the interpretations that involve poverty in judicial decisions and in the position of the social assistance services remain reinforcing stigmas about incapacity for care and social class, ignoring the role of the State in providing fundamental rights. It is concluded that the condition of poverty carries stereotypes that base prejudices against the poor classes and demarcate State intervention through the institutionalization of children and adolescents from these families.
